Acceptance of these terms

By using phoneagent.ai or signing up for PhoneAgent.ai, you agree to these terms of service. If you are acting on behalf of an organization, you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use the service. Any connected, production use of PhoneAgent.ai is also governed by the specific agreement and onboarding documentation established with each customer, which prevails over these website terms where they differ.

What PhoneAgent.ai is

PhoneAgent.ai is an AI receptionist. When connected to your calendar and phone number, it answers your inbound business calls with an AI voice agent that discloses up front that it is an AI answering on your behalf, books appointments, qualifies and routes callers, answers FAQs and takes messages, to help you stop missing calls. It runs alongside your existing calendar and booking system, on a flat monthly fee, and provides controls such as AI disclosure, consent-aware call recording and TCPA-aware texting.

The service supports your front desk. You remain responsible for the callers you serve, your consent basis for recording and texting, the accuracy of your data, and how you communicate with the people who call you. You can review and control your scripts, FAQs, after-hours rules, disclosure language and booking rules.

Your responsibilities

You are responsible for using the service in line with all laws that apply to you, including the Telephone Consumer Protection Act (TCPA), federal and state call-recording and consent rules, state laws governing AI and artificial-voice calls, and consumer protection rules. You agree to configure recording consent appropriately for the states where your callers are, to honor opt-outs for any follow-up texts, and to set your disclosure and after-hours behavior accordingly. PhoneAgent.ai provides controls to support compliant operation, but you are responsible for your own callers, your consent practices, and the way you run your front desk. You agree to provide accurate information and to only connect accounts and data you have the right to use.

Acceptable use

PhoneAgent.ai is intended for legitimate businesses answering their own inbound calls in compliance with applicable law. You agree to use the service responsibly and to comply with all applicable laws, professional standards and codes of conduct.

You agree not to use the service to:

• Record or text people in ways that break the law, including recording without the consent required in their state or ignoring opt-out requests.
• Disable or circumvent the AI disclosure, consent-aware recording or opt-out controls, or use the service to deceive the people who call you.
• Submit data you do not have the right to use, or that infringes someone else\'s rights.
• Send caller records or other sensitive data through this marketing website, which is not built to receive them.
• Attempt to disrupt, reverse engineer, scrape, or overload the service or circumvent its limits.
• Resell or redistribute the service except under a written agreement with us.

You are responsible for the data you connect and how you use the output.

Your content and data

As between you and us, you keep all rights to the data you submit and to the outputs you receive, including call recordings and transcripts. You grant us only the limited permission needed to provide the service to you. As described in our privacy policy, this website does not connect to your calendar or phone number or answer your calls. Any handling of calls, recordings, transcripts and consent data within a connected, production deployment is governed by your customer agreement.

Accounts and access

You must provide accurate information when you sign up and keep any credentials secure. You are responsible for activity that happens under your account. Tell us promptly if you believe your account or access has been used without your permission.

Plans, billing and refunds

PhoneAgent.ai is offered on paid plans only, with no free plan, billed as a flat monthly fee. Additional calls beyond your plan are billed in affordable blocks at the published rate. All prices and charges are in US dollars. Subscriptions renew automatically, monthly or yearly depending on the term you choose, until cancelled in line with your agreement. Except where required by law or stated in your agreement, payments are non-refundable. The specific commercial terms for your organization are set out in your order or agreement with us, which controls where it differs from this section.

Service availability

We work to keep PhoneAgent.ai available and performing well, but we do not guarantee uninterrupted access. We may update, change or temporarily suspend features to maintain and improve the service. Service levels for a production deployment, where applicable, are set out in your agreement.

Intellectual property

PhoneAgent.ai, including its software, models, interface, content and brand, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your agreement. You may not copy, modify, distribute or create derivative works from the service except as expressly permitted. The names of other companies and products referenced on this site are used for identification only and remain the property of their respective owners.

Disclaimers

To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service is error-free or that any specific number of calls answered, appointments booked or business outcome will result. We provide configurable controls, but we do not provide legal advice, and you remain responsible for your own legal compliance. The figures shown on this site are typical outcomes, not guarantees.

Limitation of liability

To the maximum extent permitted by law, PhoneAgent.ai and its team will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law. Our total liability for any claim will not exceed the amount you paid us for the service in the twelve months before the claim, unless your agreement provides otherwise.

Termination

You can stop using the service at any time, subject to your agreement. We may suspend or terminate access if you breach these terms or use the service in a way that risks harm to others or the platform, including recording or texting people without the consent required by law.

Changes to these terms

We may update these terms as the service evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continued use after changes means you accept the updated terms.

Governing law

These terms are governed by the laws of [governing jurisdiction], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where your customer agreement specifies otherwise.
